Rental Agreement

Effective October 26, 2026

This agreement applies to every stay booked directly with Casa Azul. You accept it when you check the agreement box on our Stripe payment page or pay our Stripe invoice, on behalf of everyone in your group. Please read it before you pay.

1. Parties, property and stay

This agreement is between Jerry Furness, owner of Casa Azul ("we," "Owner"), and the person who books and pays ("you," "Guest"). It covers a short-term vacation rental, not a lease or tenancy.

The property is Casa Azul, 635 Ave I, Port Aransas, TX 78373, Port Aransas STR licenses #011752A and #012486. Your stay is one of:

• Casa Azul Unit A (Balcony Retreat), upstairs: 2 bedrooms (king, queen) plus a queen sofa bed, 2 baths, sleeps 6.
• Casa Azul Unit B (Heart of Port Aransas), upstairs: 2 bedrooms (king, queen) plus a queen sofa bed, 2 baths, sleeps 6.
• Full House (Units A and B): 4 bedrooms plus 2 queen sofa beds, 4 baths, sleeps 12.

Your dates, stay, guest count, pets and total come from our written quote and your Stripe invoice or payment page, and are part of this agreement. The person booking must be at least 20 years old, must stay for the whole reservation, and is responsible for everyone in the group and their visitors.

2. Rates, payment and taxes

• Payment in full through Stripe reserves your dates. Dates are not held until payment goes through.
• Nightly rates vary by season and are set in your quote. Stays of 7 nights or more get 10% off the nightly rate.
• Cleaning fee: $150 per stay. Pet fee: $35 per stay.
• Hotel taxes: 6% Texas state and 9% City of Port Aransas, which we collect and remit.
• Security deposit: a refundable deposit of $150 per unit or $300 for the Full House, paid through a secure Stripe link 1 day before check-in. We refund it in full within 7 days after checkout, minus any itemized damage. We may waive, lower or raise the deposit based on your group and the purpose of your stay (for example, returning guests or a larger celebration); the amount that applies is the one in your written quote.
• We never ask for card numbers by email or text.
• Extra guests or pets not on the quote may be charged after the stay at the same rates.

3. Cancellation, weather and hurricanes

• Cancel at least 30 days before check-in: full refund.
• Cancel 7 to 30 days before check-in: 50% refund.
• Cancel less than 7 days before check-in: no refund.
• Booked at least 14 days ahead? Cancel within 48 hours of booking for a full refund.
• Cancellations must be in writing by email or text. Refunds go back through Stripe to the original payment method.
• Mandatory evacuation: if a government authority orders a mandatory evacuation of Port Aransas covering part of your stay, we refund the nights you cannot use. Forecasts, voluntary evacuations and rain do not qualify.
• If we cancel because the property is unavailable (for example storm damage or a utility outage), we refund 100% of what you paid. We are not liable for other travel costs. Travel insurance is recommended.

4. Occupancy, check-in and checkout

• Only guests named on the quote may stay overnight: up to 6 per unit, 12 for the Full House. Exceptions, such as young children or an air mattress, need our written approval before arrival.
• Check-in is at 4 PM by keypad; we send the code and directions before arrival. Checkout is at 11 AM. Late checkout only with written approval.
• Casa Azul is a raised house with stairs and no elevator.
• Before checkout: remove personal items and leftover food, tie off trash bags (on Monday or Thursday, roll the bins to the curb), set the thermostat to 75°F for AC or 68°F for heat, turn off the lights and lock the doors.

5. Pets, parking, boats and golf carts

• Dogs are welcome for the $35 pet fee: up to 2 pets, each under 50 lb, listed on the quote. Crate pets whenever they are left alone, clean up after them, and you are responsible for any pet damage.
• Park only in the private lot on the property. Don't park on the street or across from the house; the city issues tickets there.
• A boat trailer may stay in the private lot overnight. We are not responsible for boats, trailers, vehicles or their contents.
• Golf carts rented from other companies are between you and that company. Follow the city cart rules, including no carts on Highway 361 south of the Avenue G intersection.

6. House rules and off-limits areas

• No large parties or events. Small family celebrations, like a birthday dinner with your group, are welcome; ask us if you're not sure. Breaking this rule may end the stay early with no refund.
• Quiet hours are 11 PM to 7 AM.
• Smoking and vaping only outdoors on your own unit's side (your patio, balcony or yard area), never inside.
• No illegal activity on the property.
• The guest bedroom closet and the downstairs space under Unit A are owner storage and off-limits.
• The downstairs space under Unit B is shared by both units, with beach toys, coolers, chairs and the washer and dryer. The fenced backyard is shared by the two units, never the public.
• Please report anything broken or damaged right away.

7. Damage, liability and entry

• You pay for damage, missing items or extra cleaning beyond normal wear caused by anyone in your group or your pets. We deduct it from the security deposit; for anything above the deposit, we send an itemized invoice with photos and receipts within 14 days of checkout, payable within 14 days.
• The beach, water, stairs, grill, golf carts and beach gear carry normal risks, and your group uses them at its own risk. To the extent Texas law allows, we are not liable for injury, loss or theft except where caused by our negligence.
• We or a contractor may enter for emergencies, or for repairs with notice to you.
• We may end a stay without refund for a large party or event, unapproved extra guests or pets, illegal activity, or serious damage.
• Texas law governs this agreement, with venue in Nueces County.
